Most of this book was published in Dutch in November 2008, and much was originally part of author Tobias Cohen Jehoram's doctoral thesis (the other two authors are Constant van Nispen and Toon Huydecoper); the contents have been translated, updated, and amended for an international audience. The three authors are based in the Netherlands so their perspective is Dutch, and they make frequent reference to the Benelux Treaty on Intellectual Property--but with clear links in both directions to the European Trademarks Directive. The intent is an overview of the most important aspects of trademark law (rather than trademark legislation), discussion of the fundamental changes that have resulted from European harmonization of great portions of the law, and clarification of the often unclear rulings from the European Court of Justice.
