This Policy describes our data practices relating to information that identifies you personally, such as your first and last name, email address, phone number, and address (“Personal Information” or “PI”) which is supplied by you and collected by us on the Services.

II. Information Collected.
A. Information Collected Automatically.
We may automatically collect certain information about you when you access or use this Service, such as your IP address, device identifier, browser type, operating system, and information about your use of the Service (“Usage Information”). Except to the extent required by applicable law, or to the extent Usage Information is combined with Personal Information, we do not consider Usage Information to be Personal Information. We encourage you to maintain the security of your Personal Information, as well as the secrecy of your user ID and login passwords. It is your responsibility to maintain the secrecy of your user ID and login password. Please be aware that e-mail transmissions are not encrypted, and are not a secure means of transmitting financial information to us.
Whilst we have adopted security measures to protect your PI, for your protection of your PI, it is advisable that your computer, laptop or notebook be provided with software devices that protect network data transmission/receipt (such as updated antivirus systems) and that your internet service provider take appropriate measures for the security of network data transmission (such as, for examples, firewalls and anti-spam filtering).
IV.How We Use The Information We Obtain.

Kinokuniya may disclose your information to the individuals and entities listed below, but your information will not be revealed by Kinokuniya to any other third party, unless Kinokuniya has your permission, or is under either a legal or regulatory obligation or any other duty to do so:
・Kinokuniya uses the services of third party service providers to host and manage data from this Service. Data containing the information you provide will be transmitted to and hosted in data centers in the United States of America or outside the United States of America (including India) by our third party service providers, and processed and managed by such third party service providers. Our service providers are bound by confidentiality obligations with respect to the PI they process on our behalf.
・The information which you provide on this Service may be transferred within the Kinokuniya Group of corporations which may include transfer to other entities in the Group in Singapore, Japan or other jurisdictions.
・The information provided by you at this Service may also be disclosed by Kinokuniya to, and processed by:
a.Regulators and law enforcement officials;
b.Credit and charge card companies, banks and other entities processing payment instructions given by you through this Service;
c.Shipping companies to deliver orders placed by you through the Service;
d.Any agent or subcontractor acting on our behalf, including but not limited to our other service providers, vendors, consultants, attorneys and auditors; and

VI.Information You Disclose Publicly Or To Others.
The Service may permit you to post or submit user-generated content (“UGC”), such as publicly viewable reviews of our products, which may include PI. If you choose to submit UGC to any public area of the Service, your UGC will be considered “public” and will be accessible by anyone, including us. Notwithstanding anything to the contrary, unless otherwise explicitly agreed by us, PI included in UGC is not subject to our usage or sharing limitations, or other obligations, regarding PI under this Policy or otherwise, and may be used and shared by us and third parties to the fullest extent not prohibited by applicable law. We encourage you to exercise caution when making decisions about what you disclose in such public areas.
VII.Communications and Choices.
In providing your address, telephone number, facsimile number or email address you agree that Kinokuniya may contact you by mail, telephone, facsimile or email. If you have provided more than one form of contact detail, the most appropriate method of communication will be used depending on the urgency of the information. In providing this information you also permit our telephone calls to be recorded or monitored in order to offer additional security, resolve complaints and for training, administrative and quality assurance purposes. However, if you indicate with your submission of information that you do not wish to receive any promotional material from Kinokuniya, we will not send any promotional material to you.
You can opt out of receiving promotional emails or from us at any time by following the instructions provided in emails to click on the unsubscribe link, or if available by changing your communication preferences by logging onto your account. Please note that your opt-out is limited to the e-mail address used and will not affect subsequent subscriptions. If you opt-out of only certain communications, other subscription communications may continue. Even if you opt out of receiving promotional communications, we may, subject to applicable law, continue to send you non-promotional communications, such as those about your account, transactions, servicing, or our ongoing business relations.
Your browser settings may allow you to automatically transmit a “Do Not Track” signal to online services you visit. Note, however, there is no consensus among industry participants as to what “Do Not Track” means in this context. Like many online services, we currently do not alter our practices when we receive a “Do Not Track” signal from a visitor’s browser. VIII.Data Transfer.
By providing us with information, you acknowledge and agree that due to the international dimension of Kinokuniya we may store, process and use PI collected in the course of our relationship, and provide that PI to other enterprises within the Kinokuniya Group of corporations, outside your resident jurisdiction. By providing us with information, you specifically consent to the transfer of PI outside of the country or jurisdiction where it was collected for the purposes described in this Policy.
This Policy is governed by and shall be construed in accordance with the laws of New York, without giving effect to any principles of conflicts of law. By accessing this Service and providing information requested, you submit to the non-exclusive jurisdiction of New York courts. Those who choose to access this Service from any location do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.
Third-Party Services.
The Service may link to third-party websites or apps (“Third-Party Services”). These Third-Party Services may use their own cookies, web beacons, and other tracking technologies to independently collect information about you and may solicit PI from you. We do not control or monitor these Third-Party Services, including their web content. We are not responsible for, shall not be held liable for, and make no representation regarding the content, policies, or business practices of such Third-Party Services. We encourage you to pay attention when you connect to these Third-Party Services and read their terms and conditions of use and their privacy policy carefully. Our privacy policy does not apply to Third-Party Services and we are by no means liable for the privacy policy adopted by them. The Service may provide links to Third-Party Services exclusively to help you in your searches and net surfing activities. When we provide links to Third-Party Services we are not recommending the use of them and do not provide any guarantees regarding their content or the services and products supplied and sold by them.
X.Retention.
We retain PI as long as the purpose for which the PI was collected continues, unless retention is required by applicable law, such as to satisfy legal, regulatory or accounting requirements, or to protect Kinokuniya's interests, to the extent permitted by applicable law.
XI.Accessing and Changing Information.
You may view and amend PI associated with your account with us and delete your account at your convenience by logging into your account through our Service. However, if you delete your account, we will still retain your PI related to business records, such as prior transactions.
XII.Children’s Privacy.
This Service is intended for persons who are at least 18 years old. We do not knowingly request personal information as defined by the U.S. Children’s Online Privacy Protection Act (“COPPA”) from persons under the age of 13. In the event we learn that persons under the age of 13 have provided personal information to Kinokuniya through the Service, we will promptly remove such information from our records to the extent required by COPPA.
XIII.Changes to this Privacy Policy.
Kinokuniya reserves the right to amend this Policy prospectively at any time effective upon the posting of the revised Policy on this Service and your use of the Service indicates your consent to the privacy policy posted at the time of use.
