While some harmonization concerning the procedural rules of European competition law has taken place, diversity remains concerning the rules governing the bringing of the claim, those applicable to the principles that underlie the trial, those applicable to the function of the judge, those relevant to the collecting and use of evidence, and those concerning the assessment and compensation of prejudice.
